Terms and Conditions of Ski Area Verena
1. INTRODUCTION: GENERAL TERMS AND CONDITIONS
The mountain environment in which you are, due to changing weather conditions, as well as the activity of skiing and snowboarding, may lead to some risks.
The purchase of the ticket and the use of the facilities imply the knowledge and the acceptance of all the terms and conditions of sale.
(You hereby indemnify to the fullest extent Company Name from and against any and/or all liabilities, costs, demands, causes of action, damages and expenses arising in any way related to your breach of any of the provisions of these Terms.)
You will not be allowed, as a customer, to claim for injuries caused by any of the following assumptions, such as:
1. changing weather conditions
2. changing in the slope of the ground
3. snow conditions (frozen, wet, etc.)
4. ground surface conditions (non-snow spots, stones, bumps or holes)
5. impact with the structures of the ski lifts
6. collision with other skiers
7. imprudence of the skier
8. traveling on closed and / or off-piste slopes.
2. SEASONAL OPENING
The opening and closing of the winter and summer seasons is established by our company, and defined by climatic conditions, the state of the slopes, snow cover and the technical systems maintenance.
When it is imposed by mandatory technical requirements, the activity may be suspended at any time, with reference to "D.M. March 8, 1999 - Prescrizioni tecniche speciali per le funivie monofuni con movimento unidirezionale continuo e collegamento temporaneo dei veicoli- “
3. OPENING HOURS
The opening hour of the facilities is established from 8.30 a.m. to 16.30 p.m.
The timetable may vary, even without notice, during the day, for technical/safety reasons or due to force majeure.
4. EFFICIENCY AND FACILITIES
The number and type of facilities to be put into operation will be established daily by our company and may undergo variations even during the day, even without notice, for technical/safety reasons or due to force majeure.
5. HOW TO USE OUR FACILITIES
Users must follow all the instructions of the Ski Area Verena as not to represent a danger to themselves or to other customers.
The ski facilities must be used in observance of the law, observing all the prescriptions and signs located all over the ski resort.
Our company will ask restitution for direct and indirect damages caused by users’ fault or misconduct damaging persons, facilities or things owned by our company.
In the event of adverse weather conditions (strong wind or persistent wind gusts), the service may be subject to slowdowns or suspensions and, consequently, the user must be aware that the time taken for ascent and / or descent may also increase significantly. With reference to the provisions of the “D.M. 8 marzo 1999 - Prescrizioni tecniche speciali per le funivie monofuni con movimento unidirezionale continuo e collegamento temporaneo dei veicoli”.
In particular, following the art. 4.3.5, the transport service of the "Forte Verena Esaposto lift” will be suspended whenever the wind reaches an intensity as to constitute a danger to the operation and, in any case, when the intensity exceeds the so-called "Maximum operating wind". The transport service will also be suspended if atmospheric conditions affect the safety of operation or the wind blows with a significant increase in intensity or gusts that cause dangerous oscillations for vehicles or ropes.
For this reason, constituting a cause of force majeure, the cost of purchasing the round-trip ticket or the ski pass cannot be refunded.
Considering that the use of chairlifts and ski lifts presupposes skills and experience in skiing and an appropriate physical predisposition, it is forbidden for those who are not in such conditions to make use of the facilities.
Therefore, our company reserves the right to prevent the use of the lifts by people who, due to their injuries, physical or mental conditions, drunkenness and other reasons, are unable to use facilities without danger.
It is forbidden to transport things, materials and equipment (other than those strictly essential for the practising of sports in the ski area); therefore, our company does not undertake any responsibility for damage, destruction or theft of things.
In the event of accidents, injuries or when in dangerous or in order to prevent them, the user, or if he is not in a position to do so, all those who the responsibility for him, must immediately report the fact to the staff in charge so that all the appropriate measures can be arranged immediately.
It is strictly forbidden to use the lift, even when in motion, when there are signs of a closed system and when access to the starting points is closed to the public and is not supervised by the staff.
The user who does not follow the above-mentioned rules, will be responsible for damages and our company will ask the restitution for direct and indirect damages caused by users’ fault.
6. HOW TO USE THE DOWNHILL SLOPES
The groom (preparing) of the ski runs/ slopes is established by (exclusive decision) of our company.
The ski runs closed for technical or safety reasons are indicated with specific signs and it is forbidden to use them.
The rescue service only monitors the open and marked slopes.
Each skier must follow the signs placed all along the slopes.
Our company is not responsible for accidents or damages that may occur in off-piste slopes.
It is forbidden to use the ski slopes with objects other than skis, mono-skis and snowboards.
It is strictly forbidden to use sleighs or motorized vehicles and ski-bobs of any kind, even with closed slopes. Violators will be asked the restitution of any damage to the surface of the slopes and for the most serious damage.
It is forbidden to walk the ski slopes, except in cases of urgent need.
The classification of the slopes according to their difficulty degree - black, red and blue - is suggestive of the slope’s difficulties, therefore the skier must judge whether his expertise allows him to use them without suffering or causing accidents. In any case, the skier must behave in a manner that, in relation to the characteristics of the slopes and the environmental situation, does not constitute a danger to their own and others' safety.
There may be snowmobiles on the ski tracks. Skiers must give priority to the service and maintenance mechanical mobile.
All minors under the age of 14 must use a protective helmet (legge 24 dicembre 2003 –n. 363 – art. 8). The person in charge for the violation of the provision is subject to an administrative penalty from 30 to 150 euros.
7. RACES AND EVENTS
On competitions or events, our company reserves the right to close to the public some routes, tracks, areas needed for the regular running of them, for the time necessary for their execution. In such circumstances, certain facilities may be destined for the exclusive use of the athletes and personnel concerned.
For all competitions or events of any kind, our company limits to extend patented equipment and materials to the organizers, without assuming any responsibility towards the participants or third companies. The organizers will therefore be responsible for the planning of all the actions to ensure the efficient running of the competitions and events, reducing the limitations that must be imposed on normal users to the bare minimum and for the shortest possible time.
The responsibility of our company is strictly limited to the exclusive maintenance of the ski lifts, all other responsibilities are held by the organizers.
8. FARES AND TICKETS
All rates are valid for the entire season. They may, however, be changed at any time when it occurs
cost variations in the running of the lifts.
The purchase of the ticket only gives the right to use the related facilities, for the rates indicated, on the day or days of validity provided.
The user must check, when collecting the ski pass, that they correspond to his request. In fact, it is not possible to subsequently change or extend the duration of the cards already purchased.
There is no refund or return, even partial, in the event of waiting times for access to the plants, due to any reason, or in the event of interruptions in the operation due to technical or atmospheric causes, or for non-use of the plants due to events that are not attributable to negligence of our company.
Tickets that entitle you to use more than one cableway system are intended to be used on the lifts in operation at the time of their use and do not give the right to refund of any kind in the event that one or more lifts are not in operation due to technical requirements established by our company, at its sole discretion, or due to force majeure.
When the transport is performed without payment of a fee, it is understood to be done purely as a gift and is therefore carried out without the assumption of any commitment or responsibility.
All tickets are strictly personal and non-transferable. Any abuse will result in the immediate withdrawal of the ticket and the application of legal sanctions.
Tickets, such as transport documents, fulfil the function of the fiscal receipt (D.M. 30.06.1992) and must be kept for the entire duration of the transport.
The use of the tickets assumes the knowledge and acceptance of the conditions of sale.
9. PRICE BENEFITS
All non-ordinary rates, such as special benefits related to residence, age or other reasons, may be applied only by showing identity card proving unequivocally the existence of the requirements.
10. INSPECTION
Users must have the ticket before using the facility. Tickets found to be irregular or found not in the possession of the right holder will be immediately and definitively withdrawn, without prejudice to the application of administrative and criminal penalties provided by law.
The identity card certifying the right to discounted rates may be requested, in addition to the cash desks, also by the staff in the lifts or by company inspectors.
10. THEFT OR LOSS
No ticket is refunded, even partially, if the buyer cannot use them for any reason.
Likewise, no refunds or replacements will be made in the event of loss, destruction, or deterioration, except for deteriorated but still identifiable tickets which may be present at the cash desk for replacement.
